Effective 18 August 2026
Read this before you rely on the app. These Terms of Use are an agreement between you and Milan Ravasz ("the publisher") covering the Aviary Hour mobile application. Installing or using the app means you accept them. If you do not accept them, please uninstall the app.
Aviary Hour is a planning and comparison aid for people keeping birds. It organises information you supply and shows you how zone conditions line up against your birds' needs. It is not veterinary advice and does not replace your own judgement or a qualified professional's.
Terms used here
- The app
- The Aviary Hour mobile application, in any version you have installed.
- Your content
- Birds, flock details, zone notes, pins, hour plans, perch and stop setups, handling rules and anything else you enter.
- Reference content
- The species guide, zone profiles and condition data supplied with the app.
- Verdict
- The app's on-device comparison of a zone's stated conditions against your birds' recorded requirements.
Licence to use the app
The publisher grants you a personal, non-exclusive, non-transferable, revocable licence to install and use Aviary Hour on devices you own or control, for your own bird-keeping and planning purposes, including planning shared with a partner.
This licence does not transfer ownership of anything. The app, its interface, its species guide, its zone profiles and its comparison logic remain the property of the publisher and its licensors.
What you may not do
- Copy, resell, rent, sublicense or redistribute the app or its reference content.
- Reverse-engineer, decompile or disassemble the app, except where that right cannot lawfully be excluded.
- Extract the species guide or zone data in bulk to build a competing product or database.
- Remove or obscure any ownership, branding or notice inside the app.
- Use the app to break animal welfare law or the rules of any facility you visit.
The verdicts are guidance, not a guarantee
Visit Conditions and the verdict breakdown compare what you recorded about your birds — handling rules, required mesh size, minimum temperatures, sound tolerance and the rest — against what a zone is described as offering. That comparison is only as good as the information behind it.
- Zone profiles describe typical or stated conditions; the real space on the day may differ.
- Mesh sizes, perch heights, temperature floors, noise levels and occupancy can change without the app knowing.
- Weather and daylight behave as weather does — the app cannot promise conditions for a booked hour.
- Individual birds vary; a "perfect match" verdict is not a prediction about your bird's behaviour.
Your responsibility
Always inspect a zone yourself before exposing your birds to it, and follow the operator's rules. A green verdict is a starting point for your decision, never a substitute for it.
Bird welfare comes first
You remain solely responsible for the health, safety and welfare of your birds. Nothing in the app is veterinary advice. If a bird shows signs of stress, illness or injury, or if you are unsure whether an environment is safe for a species, consult an avian veterinarian or qualified keeper rather than relying on an in-app comparison.
Your content and your device
Your content belongs to you. It is stored on your device, not on a server operated by the publisher, and the publisher cannot read, recover or restore it. This means:
- You are responsible for accuracy — the verdicts depend on what you entered.
- You are responsible for backups. The app's full data reset is permanent, as is uninstalling.
- Losing, wiping or replacing your device may mean losing your flock and plans.
See the Privacy Policy for exactly what is stored and how to remove it.
Planning with a partner
Aviary Hour is designed for couples, and the Hour Plan feature shows a partner's availability beside your own. Anything you record about another person is your responsibility to record fairly and with their agreement. Booked hours in the app are your own planning records — they do not create a reservation with any aviary, facility or third party unless you separately arrange one.
Availability, updates and changes
The publisher aims to keep Aviary Hour working and current but does not guarantee uninterrupted availability. Features may be added, changed or withdrawn, and reference content may be revised as better information becomes available. Updates are delivered through your app store; older versions may stop working correctly as operating systems evolve.
App store terms
Your download is also governed by the rules of Apple's App Store or Google Play. Where those rules conflict with these Terms in relation to the download itself, the store's rules apply. The store is not a party to this agreement and is not responsible for the app, its content or any support for it; support requests go to the publisher.
Provided "as is"
To the fullest extent permitted by law, the app is supplied as is and as available, without warranties of any kind — express or implied — including fitness for a particular purpose, accuracy of reference content, or that use of the app will be uninterrupted or error-free.
Limitation of liability
To the fullest extent permitted by law, the publisher is not liable for indirect or consequential loss, loss of data, loss of planning records, or harm arising from decisions you took in reliance on a verdict, a zone profile or an hour plan. Where liability cannot be excluded, it is limited to the amount you paid for the app in the twelve months before the claim.
Consumer rights
Nothing here removes statutory consumer rights, or excludes liability for death, personal injury or fraud caused by the publisher's negligence.
Ending this agreement
You may end it at any time by deleting the app. The publisher may end it if you materially breach these Terms — for example by redistributing the app or its data. On termination the licence stops; your locally stored content simply goes with the app when you uninstall.
Changes to these Terms
These Terms may be updated to reflect new features or legal requirements. The revised version is posted here with a new effective date, and continued use after that date means acceptance. If you disagree with a change, uninstall the app.
Governing law and contact
These Terms are governed by the laws of the Slovak Republic, without prejudice to mandatory consumer protections in your country of residence. Disputes fall to the competent courts of the Slovak Republic, again subject to those protections.
